Terms of Service

This document is a template provided for product development and must be reviewed and finalised by qualified legal counsel before SecOps is offered to customers.

These Terms of Service ("Terms") govern access to and use of the SecOps platform, websites, and related services (collectively, the "Service") operated by SecOps ("SecOps", "we", "us"). By creating an account, signing in, or otherwise using the Service, you ("you", the "Customer") agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

SecOps is a multi-tenant platform that helps partners monitor and manage the Trend Micro Vision One security posture of their clients, including dashboards, reporting, and ticketing. We may add, change, or discontinue features from time to time. Trend Micro and Vision One are trademarks of their respective owners; SecOps is an independent product and is not endorsed by or affiliated with Trend Micro.

2. Accounts and access

You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must promptly notify us of any unauthorised use. Access is provided to authorised users of your organisation only, and each user belongs to exactly one partner. You must ensure your users comply with these Terms.

3. Customer data and Vision One connections

You retain all rights to the data you and your clients submit to the Service, including Vision One API credentials and the telemetry retrieved through them ("Customer Data"). You grant SecOps a limited licence to process Customer Data solely to provide and support the Service. You are responsible for obtaining any consents required to connect a client's Vision One environment and to process the resulting data.

4. Acceptable use

You agree not to misuse the Service, including by attempting to access data belonging to another tenant, probing or circumventing security or tenant-isolation controls, interfering with normal operation, or using the Service to violate any applicable law. We may suspend access to protect the Service or other customers.

5. Fees

Where the Service is provided under a paid plan, fees, billing frequency, and payment terms are set out in your order or subscription agreement. Fees are non-refundable except as required by law or expressly stated in that agreement.

6. Confidentiality

Each party may access confidential information of the other. Each party agrees to protect the other's confidential information with reasonable care and to use it only as needed to perform under these Terms.

7. Warranties and disclaimers

The Service is provided "as is" and "as available". To the maximum extent permitted by law, SecOps disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. SecOps does not warrant that the Service will be uninterrupted or error-free.

8. Limitation of liability

To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, or exemplary damages, or for lost profits or data. Each party's aggregate liability arising out of these Terms is limited as set out in your subscription agreement or, if none, to the fees paid for the Service in the twelve months preceding the claim.

9. Term and termination

These Terms apply while you use the Service. Either party may terminate for material breach not cured within a reasonable period. On termination, your right to access the Service ends and we may delete Customer Data in accordance with our data-retention practices.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified through the Service or by other reasonable means. Continued use after changes take effect constitutes acceptance.
